These Terms of Service ("Terms") govern your access to and use of the DevTech RPA platform, website, and services. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using DevTech RPA, you confirm that you are at least 18 years old, have the authority to bind your organization, and agree to these Terms and our Privacy Policy.
2. Services
DevTech RPA provides an AI-powered business automation platform including workflow builder, email AI, RPA marketplace, medical billing, accounting automation, analytics, and related tools ("Services"). We reserve the right to modify, suspend, or discontinue Services with reasonable notice.
3. Account Registration
You must provide accurate, complete information when registering. You are responsible for maintaining the confidentiality of your credentials and all activities under your account. Notify us immediately of any unauthorized access at security@devtechrpa.com.
4. Subscription and Billing
- Subscriptions are billed monthly or annually in advance
- All plans include a 14-day free trial period
- Cancellations take effect at the end of the current billing period
- We do not offer refunds for partial months, except where required by law
- We may adjust pricing with 30 days' notice; price changes do not affect current billing periods
5. Acceptable Use
You agree NOT to use DevTech RPA to:
- Violate any applicable laws or regulations
- Send spam, unsolicited emails, or bulk messages
- Process illegal content or data you have no right to use
- Attempt to gain unauthorized access to other users' accounts or data
- Reverse-engineer, decompile, or create derivative works of our platform
- Resell or sublicense the Services without our written consent
- Exceed plan limits in a way that degrades service for other users
6. Data Ownership
You retain full ownership of all data you upload to DevTech RPA. You grant us a limited license to process your data solely to provide the Services. We do not use your business data to train AI models or share it with third parties except as described in our Privacy Policy.
7. Intellectual Property
DevTech RPA and all associated software, trademarks, and content are owned by us or our licensors. You may not copy, reproduce, or create derivative works without written permission. Workflow templates you create remain your property.
8. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party. This obligation survives termination of the Agreement for 3 years.
9. Privacy and Security
Our use of your data is governed by our Privacy Policy. We implement industry-standard security measures but cannot guarantee absolute security. You are responsible for securing your own credentials and API keys.
10. Healthcare Data (HIPAA)
If you use our Medical Billing module to process Protected Health Information (PHI), you must sign a Business Associate Agreement (BAA) with us. Contact compliance@devtechrpa.com to request a BAA before processing any PHI.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVTECH RPA'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
12. Indemnification
You agree to indemnify and hold harmless DevTech RPA from claims, damages, and expenses arising from your violation of these Terms or misuse of the Services.
13. Termination
Either party may terminate at any time. We may suspend or terminate your account immediately for material breach of these Terms. Upon termination, your data will be retained for 90 days then permanently deleted, unless legally required otherwise.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which DevTech RPA is incorporated, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration, except for claims that qualify for small claims court.
15. Changes to Terms
We may update these Terms periodically. We will notify you via email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
